Terms & Conditions (T&C)

Scope

The following Terms & Conditions (T&C) apply to all participants of courses (all activities listed on www.shaolinchanarts.com — especially seminars and retreats — are referred to below as courses) organized by Chan GmbH. The T&C are based on Swiss law and apply unless expressly or implicitly acknowledged by both parties. Changes and side agreements are valid only if agreed upon in writing.

If any provision of the contractual agreements or these T&C is or becomes invalid or contains a legal gap, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by one that comes closest to the meaning of the invalid provision.

Registration

Registration for a course becomes binding once the participant submits a written registration (e.g., through the website or by email). Spots are allocated based on payment received, not registration date. Cancellations or changes must be submitted in writing (email acceptable).

Participation Fees

Participation fees vary depending on the course and are indicated in the course description. Prices are listed without VAT. Participants receive an invoice which must be paid within the stated deadline.

For retreats: Full payment is due at least 60 days before the retreat begins.

For seminars: The participation fee must be paid within 30 days of receiving the invoice, but no later than before the seminar begins.

Course Execution

Courses take place only with sufficient registrations. Chan GmbH may combine or reschedule courses. Registrations remain valid in such cases. If a course is rescheduled, participants may withdraw within a specified time. If a course is canceled, any fees already paid will be fully refunded. Program changes (e.g., schedule, instructor, venue) may occur as long as they do not significantly alter the overall character of the course.

Cancellation & Withdrawal

For Retreats

By registering, you accept our cancellation policy:

  • Up to 60 days before the retreat: only the deposit is retained.
  • Up to 30 days before: 50% of the fee is due.
  • Up to 14 days before: 70% of the fee is due.
  • Later than 14 days: the full fee is charged.

Cancellations must be submitted in writing (email accepted). If a replacement participant is found, fees may be refunded minus administrative costs. We recommend cancellation insurance.

For Seminars

Cancellations must be submitted in writing (email accepted). The following rules apply:

  • Up to 30 days before: CHF 50 processing fee.
  • Up to 14 days before: 50% of the fee is due.
  • From 13 days before, no-shows, or early withdrawal: full fee is charged.

A replacement participant may attend instead. Seminar cancellation due to illness or unforeseen circumstances requires a medical or equivalent certificate. We recommend cancellation insurance.

Liability

During all events organized by Chan GmbH, all liability for damages is excluded. Liability for damages resulting from gross negligence or intentional acts remains reserved.

Participants are responsible for their physical and mental health, as well as for adequate insurance coverage (e.g., accident, health, liability). Participation in physical exercises is at one's own risk.

Chan GmbH assumes no liability for theft or loss of items. Further claims are excluded.

Health and Personal Responsibility

Participants confirm that they are in a physical and mental condition that allows participation in the courses. Any health restrictions or relevant concerns must be communicated to the course instructors before the course begins.

The courses offered serve personal development, movement education, relaxation, and self-discovery. They do not constitute medical, psychotherapeutic, or other healthcare treatment and do not replace professional advice or therapy.

Participants take part in the courses on their own responsibility and commit to respecting their physical and mental limits. The application of the content taught and participation in physical exercises are at the participant's own responsibility.

Confidentiality & Data Protection

Chan GmbH handles all personal data according to GDPR standards, which also fulfill Swiss data protection requirements.

All collected data is treated confidentially, used only for course-related purposes, and not shared with third parties. Participants may request access or deletion at any time by emailing team@shaolinchanarts.com.

Social Media & Newsletter

Chan GmbH may take photos or videos during events. Participants will be informed beforehand and may opt out. Recordings may be used for communication purposes (e.g., website, social media, blog).

Recordings provided to participants may be used only for private purposes and not commercially without written permission.

Newsletter registration is voluntary and may be canceled at any time.

Copyright and Use of Course Content

All content and materials provided as part of the courses (in particular documents, worksheets, videos, audio recordings, live session recordings, digital content, member areas, and other course materials) are protected by copyright and are intended exclusively for the personal use of the registered participant.

Sharing course content or access credentials with third parties, as well as full or partial reproduction, publication, public disclosure, distribution, rental, sale, or other use for commercial or public purposes is prohibited without prior written consent from Chan GmbH.

In the event of violations, Chan GmbH reserves the right to block access to courses and digital offerings and to pursue further legal action.

Force Majeure

In case of unforeseeable events (e.g., natural disasters, pandemics, political unrest), Chan GmbH may postpone or cancel a course. Fees already paid will be refunded or credited.

Further claims, especially for travel or accommodation costs, are excluded.

Jurisdiction

The place of jurisdiction is Lucerne. Chan GmbH may also bring action at the participant’s domicile. Exclusively Swiss law applies, excluding CISG.

Additional Legal Notes

Chan GmbH assumes no liability for internet malfunctions, third-party damages, imported data, or links to/from other websites. Data transmission on the internet may involve security risks. Although this website is created with great care, inaccuracies may occur. Information may be changed at any time without notice.
